Dilmurad Diljan alias Dilo V. The State,

PCrLJ 2015 1389 · Balochistan High Court

This case concerns Dilmurad Diljan alias Dilo, who was convicted by a Sessions Court in Turbat for murdering Shakir Ali and sentenced to life imprisonment plus a fine. He appealed to the Balochistan High Court through jail authorities.

According to the prosecution, the victim was found severely beaten and burned, and before dying he allegedly told his brother and police that the appellant and others had assaulted him. This statement, recorded by police as a dying declaration, was the main evidence against the appellant.

The High Court found serious problems with this evidence. No eyewitness had direct knowledge of the assault, and the so-called dying declaration was not properly verified. There was no doctor's certificate confirming the victim was conscious and fit to give a statement when it was recorded, the doctor never testified to support it, and there were inconsistencies about when the victim actually arrived at the hospital. The court also noted that another key witness, the victim's brother Zareef, was never produced, raising suspicion that his testimony might not have supported the prosecution.

Given these gaps, the court ruled that a dying declaration can only support a conviction if it's shown the person was conscious, coherent, and medically certified fit when making it. Since none of this was established, the evidence was too weak and doubtful to sustain a murder conviction. The court acquitted the appellant, releasing him, emphasizing the importance of reliable proof before convicting someone of a capital offense.
