Amir Muhammad V. The State,
PCrLJ 2015 105 · Balochistan High Court
This case involved a dispute over land in Killa Saifullah, Balochistan, between two families. After earlier digging and resistance over tree plantation, the parties tried to settle their dispute through local arbitrators. However, during this peace meeting, a sudden fight broke out, with both sides throwing stones and using sticks. The appellant, Amir Muhammad, was accused of striking the deceased, Muhammad Naeem, on the head, leading to his death the next day. The trial court convicted Amir Muhammad of qatl-i-amd (intentional murder) under section 302(b) of the Pakistan Penal Code and sentenced him to life imprisonment plus compensation of Rs. 100,000.
On appeal, the Balochistan High Court examined the evidence closely. The court concluded that the fight was sudden and unplanned, arising in the heat of passion rather than through premeditation. Because of this, the court held that the appellant's culpability was lessened, converting his conviction from section 302(b) to the lesser charge under section 302(c), which applies to killings without clear premeditation.
As a result, his sentence was reduced from life imprisonment to ten years, and the compensation was lowered to Rs. 50,000. This case illustrates how Pakistani courts distinguish between premeditated murder and killings committed in sudden anger, significantly affecting
