Mustafa Ali V. The State,

PCrLJ 2014 88 · Balochistan High Court

Mustafa Ali, a manager at an NGO in Quetta, was accused of creating a fake Facebook profile in the name of a woman he knew from university, using her photos, and sending her obscene and threatening messages. He was booked under the Electronic Transactions Ordinance, 2002 and various sections of the Pakistan Penal Code covering cheating, criminal intimidation, and insulting a woman's modesty. After his arrest in March 2014, a trial court refused him bail, so he approached the Balochistan High Court seeking post-arrest bail.

The High Court granted him bail. It reasoned that since the investigation was already complete and the challan (police report) had been submitted to the trial court, there was no longer any need to keep him in custody for further questioning. It also noted that the criminal offences he was charged with under the Penal Code did not fall under the category of serious crimes where bail is normally denied, so granting bail is the norm rather than the exception. Additionally, the court pointed out that the Electronic Transactions Ordinance offences allowed for either imprisonment or a fine as punishment, and since it's uncertain which penalty a trial court would eventually impose, this uncertainty itself justified bail.

This case illustrates how Pakistani courts apply established bail principles, particularly regarding cybercrime offences with alternative penalties, and reaffirms that bail is generally granted unless a case falls into specific serious-offence categories.
