This case is about two men, Altaf Hussain and Abdul Majeed, who were travelling as passengers on a bus intercepted by police near Hub, Balochistan. Police, acting on a tip about stolen motorcycles, stopped the bus and found five motorcycles, dismantled into parts, hidden in packages on board. Several passengers, including the petitioners, were arrested and charged under section 411 of the Pakistan Penal Code for dishonestly receiving or retaining stolen property. They were convicted by a magistrate and later by a Sessions Judge on appeal, each getting three months' imprisonment.
The petitioners challenged this in the Balochistan High Court, arguing they were merely passengers with no knowledge of the hidden stolen goods, and that the prosecution failed to prove they had actual, conscious possession of the stolen parts.
The High Court agreed with them. It explained that under section 411, simply being near or on the same vehicle as stolen property isn't enough for conviction. The prosecution must prove the accused knowingly and dishonestly received or retained the stolen goods. Since the motorcycle parts were recovered from the bus itself, driven by a co-accused, and not from the personal possession of the petitioners, the prosecution failed to establish conscious possession or knowledge.
The court set aside the convictions of both lower courts and acquitted the petitioners, emphasizing that courts can and must correct clear miscarriages of justice even when lower courts agreed on the facts.
