Khan Muhammad and others V. The State,

PCrLJ 2014 449 · Balochistan High Court

This case involved two police officials, Khan Muhammad and Shah Muhammad, who sought bail after being accused of criminal breach of trust, misappropriation, and corruption under the Pakistan Penal Code and the Prevention of Corruption Act. The case arose after a large quantity of arms and ammunition, including rifles, submachine guns, and ammunition rounds, went missing from the arms storage room (Kot) at Police Lines, Barkhan. One applicant was the designated in-charge of the storeroom who had remained absent from duty before the shortage was discovered, while the other was a line officer who had reported the absence to senior officials.

The applicants argued they were not personally responsible for the missing weapons, that the matter required further investigation, and that since the offences were not among those automatically barred from bail under the law, they should be released.

The Balochistan High Court rejected both bail applications. It held that even when charges do not fall under the strict "prohibitory clause" that normally blocks bail, courts can still refuse bail in exceptional situations. Here, the accused held public office and were responsible for safeguarding weapons meant to protect the public. The missing arms had not been recovered, raising serious concerns they could be misused, and there was enough preliminary evidence linking the applicants to the offence. Given the scale of the loss and its threat to public safety, the court found this was not an ordinary case warranting bail.
