Noor Uddin V. The State,

PCrLJ 2014 308 · Balochistan High Court

This case is about the murder trial of Noor Uddin, who was convicted by an Additional Sessions Judge in Killa Abdullah, Balochistan, for killing his cousin Haji Muhammad Siddique with a Kalashnikov. He was sentenced to death under Section 302(b) of the Pakistan Penal Code, along with a fine to be paid as compensation to the deceased's family. The case came before the Balochistan High Court both as an appeal by the convict and as a mandatory reference for confirmation of the death sentence.

The defence argued that Noor Uddin was insane at the time of the crime, suffering from paranoid schizophrenia, and should be excused from criminal liability under Section 84 of the Penal Code, which protects people who cannot understand the nature of their actions due to unsoundness of mind. The court explained that raising insanity as a defence requires the accused to show real evidence of mental incapacity, not just a mental disorder in general. Reviewing the medical opinion and the accused's behavior before, during, and after the killing, the court found no proof of insanity - his conduct showed he acted deliberately after being angered by the deceased.

The court also found the evidence of eyewitnesses, medical reports, and forensic recovery of the weapon fully consistent and credible, rejecting defence attempts to discredit the witnesses simply because some were related to the deceased. The court upheld the conviction and confirmed the death sentence, showing how Pakistani courts assess insanity pleas and evaluate eyewitness reliability in
