Allauddin V. The State,
PCrLJ 2014 27 · Balochistan High Court
This case is about a man named Allauddin who was caught driving a pickup truck carrying 306 kilograms of charas (a narcotic substance) near Taftan, close to the Afghanistan-Iran border. Acting on secret information, anti-narcotics force (ANF) officials intercepted his vehicle at night, and after he tried to flee, they recovered the drugs hidden in sacks in the vehicle. He was arrested, charged under Pakistan's Control of Narcotic Substances Act, and convicted by a trial court, receiving a life sentence and a fine.
Allauddin appealed to the Balochistan High Court, arguing that there was a seven-hour delay in registering the police report (FIR) and recording witness statements, and that there were contradictions in witness testimony, which he claimed should invalidate his conviction.
The High Court rejected these arguments. It found the delay was reasonable because the arrest happened at 3am in a remote area, making it impractical to immediately reach a police station. The court also held that minor inconsistencies in witness statements were not serious enough to undermine the prosecution's case, and that testimony should be assessed as a whole rather than picking out isolated phrases.
The court upheld the conviction and life sentence, dismissing the appeal. This case illustrates how courts handle common defense arguments in narcotics cases—procedural delays and minor contradictions—showing that such issues alone usually won't overturn a conviction if the core evidence is credible.
