Shahid Hakeem V. Altaf Hussain Agha and another,
PCrLJ 2014 256 · Balochistan High Court
This case involved a dispute over farmland near Hub, Balochistan. The complainant, Altaf Hussain Agha, said he had legally purchased a large property through a court auction and had been given vacant possession, but that Javed Sikandar, associated with Bolan Castings Limited, illegally occupied a portion of the land. When the accused person named in the complaint was replaced by the appellant, Shahid Hakeem, in his role managing the company's affairs, the trial court convicted Hakeem under the Illegal Dispossession Act, 2005, sentencing him to two years' imprisonment, a fine, and compensation to the complainant.
On appeal, the Balochistan High Court examined whether Hakeem's actions actually amounted to "illegal dispossession" under the law, or merely encroachment. The court clarified that illegal dispossession requires both a wrongful act and criminal intent to grab someone's property, whereas simple encroachment lacks that intent and is legally different. The court also noted that the Act does not apply retroactively to occupation disputes that were already pending before another forum when the law came into force, but does apply if no such prior case existed.
The judgment is significant because it draws a clear legal distinction between encroachment and illegal dispossession, emphasizing that criminal liability under this Act requires proof of deliberate intent to seize property, not just continued occupation of previously encroached land. This protects individuals from criminal conviction merely for managing or occupying land inherited administratively, without proof of dishonest intent.
