Mir Hamayun Aziz Kurd and another V. Provincial Election Commissioner, Balochistan and another,
PCrLJ 2014 240 · Balochistan High Court
This case involved Mir Hamayun Aziz Kurd, who wanted to contest Pakistan's 2013 general elections for both a National Assembly seat and a Provincial Assembly seat from constituencies in Balochistan. His nomination papers were rejected by the Returning Officers because he had earlier been prosecuted under election and forgery laws for using what appeared to be a fake educational degree, allegedly from "Eire International University," to qualify as a graduate candidate in the 2008 elections under rules then requiring candidates to hold a bachelor's degree.
The appellant argued he should be allowed to contest because a criminal court had acquitted him in the forgery case. The Balochistan High Court's Election Tribunal rejected this argument. It held that a criminal court acquittal does not prove someone actually holds a valid, recognized degree — only the Higher Education Commission has authority to determine whether an institution and its degree are legitimate. Since the Higher Education Commission had found his degree invalid, his declaration that he was a graduate was a false statement, amounting to "corrupt practice" under election law, regardless of his acquittal.
The court dismissed his appeals, upholding rejection of his nomination papers.
This matters because it clarifies that criminal acquittals don't automatically restore election eligibility, and reinforces that only proper academic authorities—not courts—can certify degree validity, protecting the integrity of candidates' qualifications in Pakistan's electoral process.
