Khan Muhammad V. The State,
PCrLJ 2014 178 · Balochistan High Court
This case is about a man arrested for allegedly stealing electricity by connecting directly to a power pole and misusing a domestic electricity connection for commercial purposes. He was charged under theft laws, an electricity theft law, and an anti-corruption law, and had been in custody since July 2013. His bail request had earlier been refused by a Special Judge, so he approached the Balochistan High Court.
The High Court granted him bail. It reasoned that the investigation was already complete, so there was no longer any need to keep him in custody for questioning. It also found that the corruption law provision did not really apply to his situation, and that the remaining offences he was charged with allowed for punishment of imprisonment or fine, or fine alone. The court explained that if someone could ultimately be punished with only a fine, keeping them locked up during trial could amount to unfair double punishment, since time spent in jail cannot later be compensated if the final penalty is just a fine. The court linked this to constitutional protections against being punished twice for the same matter.
This judgment matters because it reinforces the principle that bail should normally be granted, not refused, in cases where offenses are not extremely serious, and that pretrial detention should not be used as a form of premature punishment before guilt is proven.
