The State through Prosecutor General Accountability, Pakistan V. Tariq Nouman and another,

PCrLJ 2014 1464 · Balochistan High Court

This case involved allegations of corruption after a 2004 attack on a Moharram procession in Quetta caused deaths and destruction of property. The government released about 180 million rupees in compensation, but complaints arose that officials had approved payments to undeserving people instead of genuine victims. A National Accountability Bureau reference was filed against several accused, including public officeholders, under corruption-related provisions. Before trial evidence was fully examined, the Accountability Court accepted applications filed by the accused under section 265-K of the Criminal Procedure Code and acquitted them without a full trial. The State appealed this early acquittal.

The Balochistan High Court held that acquittals granted under section 265-K (or the similar section 249-A) do not carry the same weight as acquittals reached after a complete trial, since they short-circuit the normal evidentiary process. The court stressed that in corruption cases involving public money, trial courts must be especially cautious before acquitting the accused early, and prosecutors must be given a full opportunity to prove their case. Noting that witness testimony existed, that many claims were suspicious, and that some accused had returned large sums of allegedly embezzled money, the court found this evidence needed proper explanation rather than dismissal. It set aside the acquittals and sent the cases back to resume full trial proceedings.
