Abdul Haleem V. The State,

PCrLJ 2014 1218 · Balochistan High Court

Abdul Haleem was convicted under the Control of Narcotic Substances Act, 1997 after 24 kilograms of charas (cannabis resin) were allegedly recovered from the roof of a passenger van at a checkpoint near Quetta. The trial court sentenced him to life imprisonment and a fine. He appealed to the Balochistan High Court, arguing the prosecution's evidence was weak, contradictory, and delayed.

The High Court did not rule on the merits of the conviction itself. Instead, it focused on a serious procedural flaw: the driver of the van, who had given a statement to police during investigation and was a key witness whose testimony went to the heart of the case, was never produced or examined at trial. The court found that only a token effort was made to secure his attendance, with no strong measures like bailable or non-bailable warrants used to compel him to appear. It held that the prosecutor had no legal justification to simply drop such a crucial witness, and that the trial court erred by allowing this to happen, since it deprived the defense and the court of essential evidence.

Because of this irregularity, the High Court set aside the conviction and sentence and sent the case back to the trial court, directing it to secure the driver's testimony and the accused's statement, and then decide the case afresh on its merits. The judgment underscores that courts must ensure all material witnesses are properly examined before reaching a verdict, especially in serious narcotics cases carrying life imprisonment.
