Abdul Rehman V. The State,

PCrLJ 2014 1087 · Balochistan High Court

This case involved Abdul Rehman, who was convicted by a trial court in Quetta under Section 412 of the Pakistan Penal Code for dishonestly receiving stolen property, specifically a vehicle allegedly stolen during a dacoity (armed robbery). He was sentenced to seven years imprisonment and a fine. Rehman appealed, arguing he was a genuine purchaser of the vehicle and had proper documentation to prove it.

The Balochistan High Court examined the evidence and found serious problems with the prosecution's case. Most importantly, there was no evidence showing Rehman knew the vehicle was stolen, which is a required element to prove the offense under Section 412. The court also noted that the prosecution's own evidence undermined its case: it had obtained a verification letter from the Excise and Taxation Officer confirming the vehicle's registration, which supported Rehman's claim of being a legitimate buyer. Additionally, a key document suggesting the vehicle wasn't found in official records had never been shown to Rehman during his formal examination, as required by Section 342 of the Criminal Procedure Code, so it couldn't be used against him.

Finding that the trial court had misread and overlooked evidence, the High Court ruled the prosecution failed to prove guilt beyond reasonable doubt. It overturned the conviction and acquitted Rehman. This case highlights the importance of proving criminal knowledge or intent, and the requirement that all evidence against an accused be properly presented to them during trial.
