Khadim Hussain V. The State,

PCrLJ 2013 692 · Balochistan High Court

This case is about Khadim Hussain, who was accused of murder and related offences and had been in jail since December 2009 awaiting trial. His trial had dragged on for over two and a half years without conclusion. He had earlier applied for bail, which the High Court had refused, but with a direction that the trial court finish the trial within one month. That deadline passed without progress, so he applied for bail again.

The trial court had earlier refused bail by calling him a dangerous and desperate criminal because of his alleged involvement in a previous murder case. The High Court found this reasoning flawed, since he had actually been acquitted in that earlier case, so he could not fairly be labelled dangerous or desperate.

The High Court examined a 2011 amendment to section 497 of the Criminal Procedure Code, which entitles an accused to bail if trial is delayed beyond a fixed period, unless the delay is his own fault or he falls into excluded categories like repeat offenders or dangerous criminals. Since neither exception applied here, the court held he had a statutory right to bail.

The prosecution promised to finish the trial within one month. The court ordered the trial to conclude within that time, failing which the accused would automatically be deemed granted bail. This case highlights the constitutional right to a fair and speedy trial and limits on prolonged pretrial detention.
