Ghulam Abbas v. State,

PCrLJ 2013 62 · Balochistan High Court

This case involved a murder charge arising from the death of a man named Hussain Dad in Quetta in 2008. According to the prosecution, the victim was forced into a vehicle by two brothers, Ghulam Raza and Ghulam Abbas, and shot dead. The trial court convicted Ghulam Abbas of murder under sections 302/34 of the Pakistan Penal Code, sentencing him to life imprisonment, a fine, and payment of compensation (diyat) to the victim's family. Both the convicted man and the complainant appealed: the accused sought acquittal, while the complainant sought a harsher sentence.

The Balochistan High Court examined the evidence closely and found serious problems with the prosecution's case. The father of the deceased, who filed the police report, had not actually witnessed the crime himself but relied on secondhand information.
