Arab v. State,
PCrLJ 2013 518 · Balochistan High Court
This case involves Arab, convicted of murdering Bashir Ahmed in Loralai in 2008. The dispute arose over vacating a rented shop. Bashir Ahmed was shot with a Kalashnikov near a mosque and later died from his injuries. Arab confessed to the crime before a judicial magistrate a day after his arrest, having voluntarily surrendered to police along with the weapon used. He later retracted this confession during trial, but the trial court convicted him of qatl-e-amd (intentional murder) under section 302(b) of the Pakistan Penal Code, sentencing him to life imprisonment plus compensation to the victim's family.
On appeal, the Balochistan High Court upheld the conviction but reduced the charge to section 302(c), a lesser category of murder, and cut the sentence from life imprisonment to fourteen years. The court found the confession voluntary, properly recorded following legal procedure, and supported by medical evidence and motive, even though the murder weapon's forensic report was unavailable due to a lab accident. Importantly, the court noted that before the shooting, the deceased had entered the accused's house and misbehaved, suggesting the victim's own conduct contributed to the fatal confrontation, which justified leniency in sentencing.
This judgment matters because it clarifies how courts evaluate confessions that are later withdrawn, confirms that a voluntary, credible confession alone can support conviction, and shows how provocation or victim conduct can influence sentencing even when guilt is established.
