Balochistan Public Service Commission v. National Accountability Bureau (NAB),
PCrLJ 2013 405 · Balochistan High Court
Balochistan Public Service Commission went to court after officials of the National Accountability Bureau (NAB) raided the Commission's office and seized examination records related to postings. The Commission argued that NAB had no authority to act this way because, under the Balochistan Public Service Commission Act, 1989, only the Governor can initiate an inquiry against the Commission's Chairman and members, following a specific procedure involving a High Court judge. It also claimed no proper inquiry had been sanctioned before the raid took place, making the raid illegal.
NAB argued that Commission officials, being permanent government employees, fall under the category of "persons holding public office" and are therefore subject to NAB's jurisdiction under the National Accountability Ordinance, 1999, which covers corruption and misuse of authority.
The Balochistan High Court agreed that Commission employees do count as holders of public office, and that NAB generally has power to investigate such persons. However, the court found that no inquiry had actually been sanctioned by the competent authority before NAB conducted the raid. Since the law requires that such actions follow a proper authorized process, the court ruled the raid was illegal and without jurisdiction because it happened without the required sanction.
The case matters because it reinforces the principle that even bodies with wide investigative powers, like NAB, must strictly follow the legal procedure and obtain proper authorization before taking action against public officials, protecting institutions from unauthorized raids.
