Baloch Khan V. Haji Ahmed Shah and 2 others,

PCrLJ 2013 229 · Balochistan High Court

This case involved a land sale dispute that turned into a criminal complaint. Haji Ahmed Shah sold 50 acres of land to Baloch Khan for a total price of over three crore rupees. Only part of the payment (fifty lakh rupees) was made, and the buyer allegedly backed out of the agreement without paying the rest. Instead of pursuing this as a civil matter, the seller got a police FIR registered against the buyer under sections of the Pakistan Penal Code dealing with cheating and fraud.

The buyer approached the Balochistan High Court directly, asking for the FIR to be quashed, arguing the dispute was purely civil in nature and did not amount to any criminal offence. The respondents argued he should have first approached the trial court under a different legal provision before coming to the High Court.

The High Court held that while it is normally proper to approach the trial court first, the High Court is not barred from directly using its inherent powers to prevent abuse of court process or to secure justice. Examining the facts, the judge found that the dispute was essentially a civil disagreement over an unpaid sale amount, wrongly dressed up as a criminal case. Since the FIR did not disclose any real criminal offence, the police had no jurisdiction to register it, making the whole proceeding invalid. The FIR was therefore quashed, reinforcing that civil disputes over contracts should not be misused as criminal cases.
