Juma Khan V. The State and another,
PCrLJ 2013 188 · Balochistan High Court
Juma Khan, the complainant in a firing case, went to the Balochistan High Court asking it to cancel the pre-arrest (anticipatory) bail granted to Sher Ali, the accused, in a case registered under section 324 PPC (attempt to commit qatl-e-amd). The FIR alleged that Sher Ali opened indiscriminate fire, injuring the complainant's two nephews and two passersby, and that medical evidence supported this account. The trial court had granted anticipatory bail mainly because two of the injured persons had given affidavits exonerating the accused and because there was a property dispute between the parties.
The High Court found these grounds weak. It noted that one of the affidavit-givers had actually confirmed the time, place, and manner of the attack, while the other was not even an eyewitness. It also held that a pre-existing civil or property dispute cannot automatically justify anticipatory bail, since such a dispute could just as easily be the motive for the crime rather than a reason to doubt the accusation.
Relying on Supreme Court precedent, the High Court reaffirmed that pre-arrest bail is an extraordinary remedy meant only for cases of malicious prosecution or false implication, not a routine alternative to regular bail. Since the accused failed to show any such ulterior motive and the evidence suggested a genuine, serious offence, the court set aside the trial court's order and cancelled the bail, emphasizing that fairness requires courts to correct bail orders that are perverse or unjustified.
