This case is about a man, Manzoor Hussain, who had filed a criminal complaint alleging he and his driver were abducted. During trial, his driver's testimony did not support the allegations, and the trial court acquitted the accused, declaring the original complaint false. The trial court also directed that proceedings be started against Manzoor Hussain himself for making a false complaint. Based on this direction, police registered a new case against him under sections of the Pakistan Penal Code dealing with giving false information and making false charges, and the matter proceeded to trial.
Manzoor Hussain challenged both the acquittal of the original accused and the new case against him through a constitutional petition in the Balochistan High Court. The court ruled that he could not challenge the acquittal this way because the law already provides a specific right of appeal against acquittals, which he had not used.
However, regarding the new case against him, the court found serious legal flaws. The relevant offences could only be prosecuted following specific procedures - requiring a written complaint from a police officer or from a court - and these procedures were not followed. Instead, police registered the case simply on a letter from a District Attorney. The court held that skipping these mandatory legal steps made the entire case unlawful and without jurisdiction. It therefore quashed the case against Manzoor Hussain, while leaving the earlier acquittal untouched. This shows the importance of following proper legal procedure before prosecuting someone.
یہ مقدمہ منظور حسین نامی ایک شخص سے متعلق ہے جس نے ایک فوجداری شکایت درج کرائی تھی جس میں الزام لگایا گیا تھا کہ اسے اور اس کے ڈرائیور کو اغوا کیا گیا ہے۔ مقدمے کی سماعت کے دوران اس کے ڈرائیور کی گواہی الزامات کی تصدیق نہ کر سکی، جس پر ٹرائل کورٹ نے ملزمان کو بری کر دیا اور اصل شکایت کو جھوٹا قرار دیا۔ ٹرائل کورٹ نے یہ بھی حکم دیا کہ منظور حسین کے خلاف جھوٹی شکایت درج کرانے پر کارروائی شروع کی جائے۔ اسی حکم کی بنیاد پر پولیس نے پاکستان پینل کوڈ کی ان دفعات کے تحت اس کے خلاف نیا مقدمہ درج کیا جو غلط اطلاع دینے اور جھوٹے الزامات عائد کرنے سے متعلق ہیں، اور معاملہ ٹرائل کے لیے آگے بڑھا۔
منظور حسین نے اصل ملزمان کی بریت اور اپنے خلاف نئے مقدمے، دونوں کو ایک آئینی درخواست کے ذریعے بلوچستان ہائی کورٹ میں چیلنج کیا۔ عدالت نے قرار دیا کہ وہ بریت کو اس طریقے سے چیلنج نہیں کر سکتا کیونکہ قانون پہلے ہی بریت کے خلاف
