Naseeb Gul v. Amir Jan,

PCrLJ 2013 175 · Balochistan High Court

This case is about a criminal appeal under Section 489-F of the Pakistan Penal Code, which punishes dishonestly issuing a cheque that later bounces. The complainant, Naseeb Gul, accused Amir Jan of issuing a cheque worth over ten lakh rupees to repay a loan, which was dishonoured when presented to the bank. A trial court convicted Amir Jan, but on appeal the Sessions Judge acquitted him. Naseeb Gul then challenged that acquittal before the Balochistan High Court.

The High Court upheld the acquittal. It explained that simply issuing a cheque that bounces is not automatically a crime — the law requires proof that the person acted dishonestly, meaning with fraudulent intent to cheat or humiliate the payee. In this case, evidence showed the complainant himself had physically confronted the accused and pressured him into writing the cheque, meaning it wasn't given voluntarily. A bank witness also revealed that the complainant had a signed blank cheque from the accused's account, filled it in himself, and submitted it despite being told there were no funds — suggesting the complainant was trying to trap the accused rather than being defrauded. No witnesses were produced to show dishonest intent, nor were the loan's terms disclosed.

The judgment matters because it clarifies that dishonesty is an essential element for a cheque-bouncing conviction, protecting people from being criminally punished merely because a cheque failed to clear.
