Munir Ahmed V. Election Commission of Pakistan, Islamabad and 3 others,

PCrLJ 2013 1583 · Balochistan High Court

This case concerned an appeal challenging a Returning Officer's decision to accept the nomination papers of a candidate, Mir Mohabat Khan Marri, for a Provincial Assembly seat from constituency PB-23 Kohlu in the 2013 general elections. An elector, Munir Ahmed, argued that the candidate should have been disqualified because the Election Commission of Pakistan had already found, in an earlier order, that the candidate had made a false declaration about holding a B.A. degree when he did not actually possess one, and had used this fake academic qualification to become a Senator. The Election Commission had directed that his Senate seat be de-notified and that any nomination papers he filed for the new election be rejected.

The candidate's lawyer argued the appeal was not maintainable because the appellant had not formally objected before the Returning Officer, and that there was insufficient evidence the degree was fake.

The Balochistan High Court held that the Returning Officer has a duty to actively ensure only qualified candidates contest elections, rather than waiting passively for objections. Relying on the Election Commission's clear findings and a related Supreme Court order, the Court held that making a false declaration about educational qualifications amounts to a permanent disqualification under Articles 62 and 63 of the Constitution. The Court allowed the appeal, ruling the candidate's nomination papers should be rejected and his name excluded from the list of validly nominated candidates.

This case highlights how false claims about qualifications can permanently bar someone from contesting elections, and clarifies
