Muhammad Akram V. The State,

PCrLJ 2013 1535 · Balochistan High Court

In this case, a court employee (a "Naib Court," a junior court official) was accused of tampering with official court papers to help a convicted prisoner escape punishment. The prisoner, Zaman Khan, had been sentenced to 14 years in prison, but the appellant allegedly altered his remand papers to falsely show an acquittal instead of a conviction, and then got a judge to sign these fraudulent papers, leading to the prisoner's release. He was later re-arrested, exposing the fraud. The trial court convicted the appellant under Section 218 of the Pakistan Penal Code (dealing with public servants falsifying records to save someone from punishment), sentencing him to one year in prison plus a fine.

On appeal, the Balochistan High Court found serious problems with how the case had been investigated and prosecuted. The court noted that other people who may have been involved—such as jail staff responsible for the prisoner's movement, or others connected to the fraudulent process—were never investigated or charged. The court felt that convicting only this one low-level official while letting other possibly responsible parties go free was unjust and incomplete justice.

Rather than deciding guilt or innocence, the High Court set aside the lower court's judgment entirely and sent the case back for fresh investigation, ordering police to identify and charge everyone potentially involved, and directing a full trial of all such persons, to be completed promptly. This case highlights the importance of thorough, fair investigations rather than scapegoating a single individual.
