The State v. Nawabzada Shah Zain Bugti,

PCrLJ 2013 147 · Balochistan High Court

The case involved a criminal trial in Quetta arising from an FIR alleging that a large quantity of illegal arms and ammunition was recovered from Nawabzada Shah Zain Bugti and other accused persons. During the trial, the sole police eyewitness died. The prosecution then asked the trial court, under Section 540 of the Criminal Procedure Code, to allow two Army officers who were present at the scene and involved in the recovery to be brought in as additional witnesses, even though their names were not originally listed in the police challan.

The trial court refused, reasoning that similar evidence was already on record and questioning why these witnesses were not included earlier if they were so important.

The Balochistan High Court disagreed and set aside that order. It held that Section 540 gives courts wide power to summon any person whose evidence is essential for reaching a just decision, and this power must be exercised sensibly based on the case's circumstances. Since the only eyewitness had died, the court found it fair and necessary to let the prosecution bring forward the two remaining eyewitnesses. While acknowledging the prosecution had been negligent in not listing them earlier, the court stressed that some evidence needed to come on record to ensure a fair outcome for both sides. The prosecution was allowed to produce these witnesses without delay.

This case highlights how courts balance procedural lapses against the broader goal of ensuring justice is served through adequate evidence.
