Noor Ahmed V. The State,
PCrLJ 2013 1452 · Balochistan High Court
This case is about Noor Ahmed, who was convicted of murder (qatl-e-amd) by a Sessions Court in Noshki and sentenced to life imprisonment plus a fine, for allegedly shooting a man who had merely asked for drinking water at a shop. Ahmed appealed to the Balochistan High Court.
The prosecution relied mainly on two supposed eyewitnesses. However, the court found serious problems with their testimony. One witness, though named as an eyewitness in the original police report (FIR), gave only a vague description of the attacker and never actually claimed he could identify him—he also failed to pick out the accused in an identification parade and denied knowing the culprit beforehand. The second witness was not even mentioned as an eyewitness in the FIR, and his statement was recorded after an unexplained delay. Both witnesses' accounts contradicted each other in important ways.
Because of these gaps and contradictions, the High Court ruled that the prosecution had not proven guilt beyond reasonable doubt. It overturned the conviction, acquitted Noor Ahmed, and ordered his release.
The judgment reinforces an important principle in criminal law: even a single serious doubt in the prosecution's case entitles the accused to acquittal as a matter of right, not favor. The court also invoked the Islamic legal principle that it is better to mistakenly acquit a guilty person than to wrongly convict an innocent one, emphasizing the high standard of proof required before someone can be deprived of liberty or life.
