Abdul Baqi v. The State,

PCrLJ 2013 127 · Balochistan High Court

Abdul Baqi was tried for murdering Ali Muhammad, who disappeared after dinner and was later found dead with severe injuries near date palm trees. The initial FIR named four suspects based on suspicion, but police investigation cleared three of them, leaving only Abdul Baqi to face trial. There was no eyewitness, so the case rested on circumstantial evidence: Abdul Baqi led police to the crime scene and to a blood-stained axe used as the murder weapon, which forensic testing confirmed was linked to the killing. He also gave a confession before a magistrate, though it was recorded about six days after his arrest.

The trial court convicted him and sentenced him to death. On appeal, the Balochistan High Court examined whether the delayed confession and the recovery of the weapon were legally valid evidence. It held that a confession's delay does not matter if it was voluntary, truthful, and made within the legal remand period. The court found the chain of evidence—from pointing out the location, to recovering the axe, to the confession—was consistent and reliable, proving guilt beyond doubt.

The court also upheld the acquittal of a co-accused, since no evidence showed she helped in the murder and she wasn't given a chance to cross-examine.

Finding the murder deliberate, cold-blooded, and committed against a defenseless victim at night, the court ruled there were no mitigating circumstances. It dismissed the appeal and confirmed the death sentence, reinforcing how confessions and circumstantial evidence can support capital punishment when
