State v. Noor-ud-Din,

PCrLJ 2013 1089 · Balochistan High Court

This case involved the killing of a man, Nazeer Ahmed, and a woman, Mst. Zubaida, on allegations of "Karo Kari" (so-called honour killing). According to the prosecution, the accused persons kidnapped Nazeer Ahmed, took him to a house where an illegal Jirga (informal tribal council) was held, and then both victims were murdered. A trial court in Quetta heard the case and acquitted all the accused. The State appealed against this acquittal to the Balochistan High Court.

The central legal question was whether the ordinary trial court even had the authority to hear this case, since the killings arose from an alleged illegal Jirga proceeding relating to honour-based violence, which the law treats as a form of terrorism-related offence requiring trial before a Special Anti-Terrorism Court, not an ordinary Sessions Court. The High Court found that a confessional statement by one of the accused confirmed that two innocent people had been murdered over a Karo Kari allegation, which meant the case fell under the jurisdiction of the Anti-Terrorism Court. Since the trial court lacked jurisdiction to try the case in the first place, its acquittal was invalid and could not protect the accused from being tried again, even under the rule against double jeopardy, because that protection only applies when the original trial was conducted by a competent court.

The High Court therefore set aside the acquittal and sent the case back for a fresh trial before the Anti-Terrorism Court. This judgment reinforces that jurisdiction matters fundamentally
