Tahir Mehmood Inspector of Police (Investigation) V. The State through Prosecutor-General, Balochistan,

PCrLJ 2013 1057 · Balochistan High Court

This case involved a police inspector, Tahir Mehmood, who was convicted by an Anti-Corruption Special Judge in Quetta for accepting a bribe (illegal gratification) under section 161 of the Pakistan Penal Code and section 5(2) of the Prevention of Corruption Act, 1947. He was sentenced to two years' rigorous imprisonment along with a fine. The allegation was that he took Rs. 40,000 from a complainant to help release a relative detained in a narcotics case, then demanded a further Rs. 30,000, leading to a police trap in which he was allegedly caught red-handed with marked currency notes, though he reportedly escaped custody afterward.

The inspector appealed, arguing the prosecution's evidence was unreliable, several key witnesses (including the complainant himself) turned hostile and did not support the case, and the trap raid had been conducted without a magistrate present.

The Balochistan High Court found that while the absence of a magistrate during the raid did not automatically invalidate the proceedings, the prosecution still needed strong, specific evidence to prove bribery.
