Ghulam Mohammad v. The State,
PCrLJ 2013 105 · Balochistan High Court
This is an explainer of a Balochistan High Court decision on Criminal Jail Appeal No. 40 of 2010, decided in September 2012.
The case involved Ghulam Muhammad, who was tried after an FIR was registered and a charge framed against him under the Offences Against Property (Enforcement of Hudood) Ordinance, 1979, specifically for "haraabah" (a form of armed robbery/dacoity under Hudood law). However, when the trial court found him guilty, it ended up sentencing him under section 302(b) of the Pakistan Penal Code (for murder), giving him life imprisonment, rather than sentencing him under the Hudood Ordinance itself.
This created confusion about which appellate court should hear his appeal: the High Court or the Federal Shariat Court, since different laws send appeals to different forums.
The High Court ruled that it is the charge originally framed against the accused - not the sentence eventually imposed - that determines which court has jurisdiction to hear the appeal. Since the FIR and the charge here were both framed under the Hudood Ordinance's haraabah provisions, the case belonged in the Federal Shariat Court, even though the trial judge had ultimately imposed punishment using a Penal Code section (which the law allows when Hudood standards of proof aren't met).
The court therefore transferred the appeal to the Federal Shariat Court rather than deciding it themselves.
This matters because it clarifies an important jurisdictional rule: the forum for appeal in such cases is fixed by the
