Attaullah v. the State,

PCrLJ 2012 780 · Balochistan High Court

This case involved Attaullah, who was convicted under Pakistan's Control of Narcotic Substances Act, 1997, for possessing a large quantity of charas (hashish). Acting on a tip, police raided a house and found 264 bundles plus additional loose rods of charas weighing about 180 kilograms total, along with weapons. Attaullah and others present were armed; he was convicted, sentenced to 14 years' imprisonment and a fine, and appealed to the Balochistan High Court.

His lawyer argued several points: that the investigation was improperly conducted by a special police unit (CIA) rather than regular police; that mandatory procedural requirements for searches and witness presence were not followed; that there was no proof he owned or controlled the house; that there was unexplained delay in sending the narcotics for chemical testing; and that samples weren't drawn from every single rod of charas.

The High Court rejected all these arguments. The court also found that minor irregularities—like the case being investigated by CIA staff, or delays in testing—did not cause real prejudice or invalidate the trial, since the location was found to be a narcotics den rather than an ordinary residence justifying warrantless action.

The court dismissed the appeal and upheld the conviction, showing that in serious narcotics cases, courts will overl
