Bibi Hanifa V. Dr. Jamila Gynaecologist, Civil Hospital Pishin,
PCrLJ 2012 768 · Balochistan High Court
This case involved a woman, Bibi Hanifa, who underwent surgery at a government hospital in Pishin during a difficult childbirth. She later accused the doctors involved of negligence, alleging that her baby died due to their carelessness and that two surgical sponges were left inside her abdomen after the operation, causing her pain. She filed a private criminal complaint against the doctors under a section of the Pakistan Penal Code dealing with causing hurt through rash or negligent acts. The trial court acquitted the doctors, and she then sought leave to appeal against that acquittal before the Balochistan High Court.
The High Court refused to grant leave to appeal, upholding the acquittal. It noted that the complaint was filed nine months after the operation with no explanation for the delay, and that the doctor who actually performed the surgery had not even been named as an accused. The evidence showed the operation was carried out in an emergency situation with the husband's consent and was successful in delivering a live baby, who died later of natural causes. The alleged sponges were never mentioned during the initial inquiry or trial, undermining that claim. The court reaffirmed the legal principle that an acquittal carries a strong presumption of innocence that should not be disturbed unless the original decision was clearly unreasonable or unjust, which was not the case here.
