Zahoor Ahmed V. The State,
PCrLJ 2012 672 · Balochistan High Court
This case involved the murder of Haji Muhammad, who was shot dead in broad daylight along with an injury caused to another bystander, Zahid Hussain. According to the prosecution, the appellant Zahoor Ahmed, along with two co-accused, opened fire on the deceased following a dispute linked to a matrimonial matter. The complainant, the deceased's son, promptly reported the incident to police, and the appellant was later arrested with a pistol that forensic experts linked to the crime.
The trial court convicted Zahoor Ahmed and sentenced him to death, along with additional punishment for the injury caused to the other victim. He appealed, seeking acquittal, while the case was also sent to the High Court for confirmation of the death sentence.
The Balochistan High Court examined the eyewitness accounts, medical evidence, and recovery of the weapon, and found the prosecution had proven his involvement in the killing beyond doubt. However, since three men were accused of firing and it could not be established whose bullet actually caused death, the court held that awarding the death penalty to only one accused was not justified. The court also noted the prosecution failed to prove the alleged motive despite claiming one.
As a result, the death sentence was converted to life imprisonment, with credit given for time already spent in custody. This case highlights how courts distinguish between proving guilt and justifying the harshest punishment when multiple people share responsibility for a single act.
