Abdul Wahid v. the State,
PCrLJ 2012 614 · Balochistan High Court
This case involved Abdul Wahid, who was convicted by a trial court in Khuzdar, Balochistan and sentenced to death for the murder of Hussain Bakhsh, who was shot while sleeping under a mosquito net in his home at night. The complainant, the victim's father, initially said in his police report that it was dark and he could not identify the shooter, but later the prosecution presented eyewitnesses claiming they had identified the appellant. Co-accused in the same case had already been acquitted by the trial court.
On appeal, the Balochistan High Court found the prosecution's case deeply flawed. Since all witnesses agreed there was no electric light and no other light source such as a torch or moonlight was mentioned, the court held it was not actually possible to identify anyone in the darkness, making the witnesses' claimed identification unreliable. The original FIR did not even name the appellant as the culprit, suggesting he was implicated later based on suspicion arising from prior family enmity. The court also found major contradictions regarding recovery of the alleged murder weapon, undermining the ballistics evidence, and noted medical evidence could not identify the actual perpetrator.
Applying the principle that any reasonable doubt must benefit the accused as a matter of right, not favor, the court set aside the conviction and death sentence, acquitting Abdul Wahid entirely. The case underscores how convictions, especially on capital charges, require solid, consistent evidence, and that doubtful eyewitness identification and contradictory investigation cannot sustain a murder con
