Haji Ghous-ud-Din v. The state through NAB authorities,
PCrLJ 2012 606 · Balochistan High Court
This case involved a man convicted by an Accountability Court in Quetta for corruption offenses under the National Accountability Ordinance. He was sentenced to prison and fined a large sum of money, with his properties to be auctioned to recover the fine if it wasn't paid. His appeal to the High Court reduced the fine amount, and his further petition to the Supreme Court was dismissed. He then served the alternative prison sentence for non-payment of the fine and later asked the Accountability Court to release his attached properties, arguing that since he had already served extra jail time in place of paying the fine, the authorities could no longer seize his property to recover it. The trial court rejected his request and instead allowed the authorities to auction his properties to recover the fine, and he appealed that decision.
The Balochistan High Court dismissed his appeal. It held that serving imprisonment in default of paying a fine does not cancel the obligation to pay the fine itself; the two are separate. The fine could still be recovered as arrears of land revenue under the relevant law, since the amount had been clearly fixed by the Supreme Court. The court also clarified that in NAB cases, a "fine" isn't just punishment but is meant to recover misappropriated public money and compensate the state. It further explained that recovery proceedings were within the legal time limit, counted from the Supreme Court's final order. This case matters because it confirms that convicts in corruption cases cannot escape repaying looted public money simply by serving extra jail time instead.
