Abdul Rehman V. The State,

PCrLJ 2012 559 · Balochistan High Court

This case involved a man accused of murdering his wife after allegedly finding her with another man. The prosecution's story was that the accused confessed to strangling his wife to companions at a gathering, and the wife's body was later found at her family's home. He was convicted by a trial court in Dera Allah Yar and sentenced to life imprisonment for murder, plus a fine.

On appeal, the Balochistan High Court overturned the conviction and acquitted the accused. The court found the prosecution's case riddled with serious problems: the two main witnesses were closely related to each other and hostile toward the accused; their accounts contradicted each other on important points; one witness's testimony was pure hearsay since he hadn't witnessed anything himself and only learned of events six days later without explanation; and the deceased's own father had separately accused different people (not this appellant) of the murder in a formal complaint. A key prosecution witness who was declared hostile did not actually testify against the accused. The alleged motive was never proven, and medical evidence alone could not identify who committed the crime. The court also noted that withholding key evidence creates a legal presumption that it would have been unfavorable to the party withholding it.

This judgment matters because it reinforces important legal principles: convictions must rest on credible, consistent evidence beyond reasonable doubt; motive, once alleged, must be proven; and courts must critically scrutinize witness credibility, especially in cases relying on circumstantial or interested testimony rather than direct evidence.
