Ghulam Rasool v. the State,
PCrLJ 2012 415 · Balochistan High Court
This case involved a man named Ghulam Rasool who was accused of abducting a young woman, Ghazala Bibi, under Pakistan's Penal Code provisions dealing with abduction and unlawful assembly. The complainant, Ghazala's father, alleged that Rasool, who worked as a driver for a health program van, took his daughter away on 19 June 2011 and she never returned home. Rasool sought pre-arrest bail from the Balochistan High Court, arguing that the case was false and malicious because Ghazala had actually married him of her own free will under Islamic law.
The court examined an affidavit from Ghazala herself, which she also personally confirmed before the judge. In it, she stated she was an adult, unmarried woman who chose to marry Rasool out of love, without any pressure or coercion. Based on this, the judge concluded the abduction complaint appeared motivated by malice, aimed at damaging Rasool's honour and reputation, rather than reflecting a genuine crime.
The court held that superior courts can grant pre-arrest bail directly, bypassing lower courts, when an accused shows he was prevented from approaching them safely, and when it appears no real offence occurred, bail should not be denied on mere technicalities. Citing a Supreme Court precedent, the judge granted Rasool pre-arrest bail, confirming the earlier interim bail.
This case matters because it illustrates how courts protect individuals from abuse of the criminal justice system in cases where families file abduction complaints against men who marry women of their choice.
