Shaukat V. The State,
PCrLJ 2012 357 · Balochistan High Court
This case involved a robbery appeal before the Balochistan High Court. The appellant, Shaukat, had been convicted by a Sessions Judge and sentenced to four years imprisonment plus a fine under Section 394 of the Pakistan Penal Code, which deals with robbery. The prosecution's case was that Shaukat and an accomplice robbed the complainant, his nephew, and his brother of cash and mobile phones at gunpoint, and that the victims recognized Shaukat as their neighbour.
On appeal, the High Court found serious problems with the prosecution's evidence. The complainant admitted he named Shaukat only on suspicion, after police pressured him to identify someone. There was also an unexplained two-hour delay before the police registered the case, during which the complainant appeared to have been kept waiting until a report implicating Shaukat was prepared. This raised concerns that the investigating officer had a personal interest in securing a conviction, especially since he was accused of bias against the accused. Additionally, no stolen property or weapon was ever recovered from Shaukat, and the brother who was also robbed was never called to testify, weakening the case further. The court noted that simply pointing out a location already known to police, without any recovery resulting from it, proved nothing.
Given these gaps and the unreliable identification process, the High Court acquitted Shaukat. The case highlights how courts scrutinize police conduct, delays in reporting crimes, and missing evidence to prevent wrongful convictions based on weak or manipulated testimony.
