Michael Nazir v. The State,
PCrLJ 2012 33 · Balochistan High Court
Michael Nazir was tried for killing two people and wounding two others after a dispute at a church in Quetta. He had been removed from his position as church leader (Padri), and when church officials, including a lawyer and committee members, went to ask him to vacate church property, he allegedly opened fire on them with a pistol, killing Noor Muhammad Achakzai and Iqbal Masih instantly and injuring two others, Yousaf Masih and Saleem Raza.
The trial court had convicted him under anti-terrorism and murder laws but only sentenced him to life imprisonment, reasoning that he lacked clear criminal intent (mens rea). Nazir appealed his conviction, claiming he was falsely implicated because he had converted to Islam. Separately, the state appealed, seeking the death penalty instead of life imprisonment.
The Balochistan High Court found the prosecution's evidence—eyewitness accounts, medical reports, recovered weapon, and ballistic findings—consistent and convincing, and rejected the defense's claim as baseless. The court also disagreed with the trial court's finding that there was no intention to kill, holding that repeated firing at vital body parts by an educated person clearly showed intent to cause death.
As a result, the court dismissed Nazir's appeal against conviction, but allowed the state's appeal, enhancing his sentence from life imprisonment to death. The case illustrates how appellate courts can increase sentences when they find the original punishment too lenient given the evidence of deliberate intent.
