Khan Muhammad v State,

PCrLJ 2012 322 · Balochistan High Court

This case involved an appeal by Khan Muhammad, who had been convicted by a Sessions Court in Turbat for murdering his elder brother Yar Muhammad and his nephew Naveed, and for seriously injuring his niece Mst. Gulshan, following a dispute over ancestral property. He was sentenced to death for the murders, along with additional prison terms and fines for the other offences. The trial court referred the death sentence to the Balochistan High Court for confirmation, and the convict separately appealed against his conviction.

The High Court examined the evidence, which included eyewitness testimony from people who were inside the house at the time of the killings, medical evidence confirming the injuries, and physical evidence such as a recovered Kalashnikov rifle, spent cartridges, and a bullet, all matched to the weapon through a firearms expert's report. The defense argued that witnesses were biased relatives and that some statements were recorded late without explanation, but the court found the witnesses consistent and credible, noting that being related to the victims does not automatically make testimony unreliable if the witness is otherwise truthful and was present at the scene.

The court concluded that the prosecution had proven its case fully, that the accused acted in a brutal and calculated manner, and that no circumstances justified leniency. It upheld the conviction and sentence, emphasizing that courts have a duty to victims and society to impose punishments that deter serious crime.
