Muhammad Illyas v. The State,

PCrLJ 2012 303 · Balochistan High Court

This case is about a man named Muhammad Ilyas who was caught driving a vehicle carrying 25 kilograms of hashish, hidden under bedding in the car. He was traveling with two other men, one a passenger and one a cleaner. A trial court convicted him under Pakistan's narcotics law and sentenced him to life imprisonment plus a fine. He appealed to the Balochistan High Court, arguing that the prosecution's case was weak because of delays in filing the police report, delays in sending drug samples for testing, lack of independent witnesses, and contradictions in witness statements. He also argued that a co-passenger had confessed that the drugs and bedding belonged to him, so Ilyas should not be held responsible.

The High Court rejected the appeal. It noted that Ilyas never denied that the drugs were found in his vehicle while he was driving it, so minor contradictions in witness testimony mattered less. Under the law, once possession is established, there is a legal presumption of guilt against the accused. The co-accused's confession only covered 4 kilograms of the hashish, leaving 21 kilograms unexplained. Since Ilyas offered no explanation for this remaining amount found in his vehicle, the court held he failed to prove his innocence. The court therefore upheld his life sentence, reinforcing how narcotics law places the burden on the person in control of a vehicle to account for drugs found in it.
