Abdul Sattar v. Federation of Pakistan,

PCrLJ 2012 281 · Balochistan High Court

This case involved Abdul Sattar, who claimed he had been interviewed and declared qualified for the post of Assistant Lineman at the Quetta Electric Supply Company (QESCO). He alleged that after the Director of Human Resources passed away, his appointment letter was withheld so that other, favored candidates could be given the job instead. He asked the Balochistan High Court to direct QESCO to issue him an appointment letter.

The High Court dismissed the petition. It found that the petitioner could not produce any document proving he had actually participated in the interview, let alone that he had been declared qualified or selected. The interview call letter itself contained a clear disclaimer stating that merely being called for interview did not create any right to a job, and that eligibility would only be finally decided after interview, medical examination, and verification of documents. The court also noted that the petitioner had waited almost two years after the interview before filing his case, without explaining this delay.

The judges held that to invoke the High Court's constitutional jurisdiction under Article 199, a person must show an existing legal or fundamental right that has been violated. Since no law or rule gave the petitioner a right to appointment, and he failed to prove any such right was infringed, he had no standing to bring the case. The petition was dismissed at the initial stage.
