Muhammad Azam Kasi v. State,
PCrLJ 2012 1950 · Balochistan High Court
This case involved Dr. Muhammad Azam Kasi, a former Director-General of Livestock, whose bank accounts were frozen during a National Accountability Bureau (NAB) inquiry against him. NAB's Director-General froze five accounts in December 2011, and later that month a NAB prosecutor asked the Accountability Court to confirm the freeze, even though no formal reference (the actual corruption case) had yet been filed against him. The trial court rejected his objections and confirmed the freeze in February 2012, prompting this appeal.
The Balochistan High Court ruled in his favor. It explained that under Article 23 of the Constitution, people have a right to hold and dispose of property, and any restriction on that right must be reasonable and time-limited. The law only allows the Chairman of NAB to freeze property for 15 days, after which a reference must be filed in court for further confirmation. Since no reference had actually been filed here, confirming the freeze indefinitely meant the accounts could remain frozen forever without any real case being pursued—something the court found unlawful and unconstitutional. The court also noted that a person must be properly informed when their property is frozen, since the law gives only 14 days to object.
As a result, the High Court set aside the freezing order and directed that the appellant's bank accounts be released immediately, reinforcing that property rights cannot be suspended indefinitely without formal charges being filed.
