State through Additional Prosecutor ATA V. Hashim Khan,

PCrLJ 2012 1871 · Balochistan High Court

This case involved an appeal by the State against the acquittal of Hashim Khan and others, who had been accused of murder, attempted murder, and armed rioting under Pakistan's Penal Code and Anti-Terrorism Act. The incident stemmed from a property dispute, allegedly resulting in an ambush where the accused shot at a vehicle, killing one person and prompting a return of fire from the victims' side.

The trial court had acquitted the accused, and the State challenged this decision, arguing the trial judge had ignored important evidence, including eyewitness testimony from the complainant who was present at the scene.

The Balochistan High Court found a serious flaw in how the case had been handled: although the initial police report named eyewitnesses present at the scene, the investigating officer failed to include the most important witness in the list of prosecution witnesses presented at trial. The trial court also failed to summon this key witness on its own initiative, even though the law empowers judges to ensure all relevant witnesses are produced, regardless of whether their testimony might help or hurt the prosecution's case.

Because this crucial witness was never heard, the High Court ruled that a fair decision could not have been reached. It set aside the trial court's acquittal and ordered a retrial, directing that all necessary witnesses from both sides be called this time. This case highlights the importance of ensuring complete evidence is presented before a court reaches a verdict, especially in serious criminal cases.
