PCrLJ 2012 1847 · Balochistan High Court
This case involved a family land dispute in Gwadar, Balochistan. The petitioners claimed they were the rightful owners of certain land inherited from their grandfather, but said the respondents, with help from revenue officials, had fraudulently transferred the land records (mutation) into their own names. The trial court dismissed the petitioners' suits after hearing evidence. When the petitioners appealed, the appellate court refused to even hear the appeal, returning it on the technical ground that the case's value exceeded its pecuniary jurisdiction, partly based on a compensation amount reportedly paid by the Civil Aviation Authority for the land.
The High Court found this approach wrong. It held that if a court believes a suit is undervalued, it must give the plaintiff a chance to correct the valuation before rejecting the case, which had not happened here. It also clarified that for deciding which court has jurisdiction, the value stated in the suit itself matters, not the property's market value or any compensation figure, unless that valuation is formally challenged and a proper issue is framed. The High Court also noted that courts can add necessary parties with an interest in a case, such as the Civil Aviation Authority here, using their inherent powers.
As a result, the High Court set aside the appellate court's order and sent the case back for fresh proceedings, directing that proper issues on valuation and court fees be framed first. This case matters because it reinforces that technical jurisdictional objections cannot be used to deny litigants a fair hearing without following proper procedure.
