Abdul Jabbar v. Mohammad Shareef & others,

PCrLJ 2012 1791 · Balochistan High Court

This case is about a criminal complaint filed by Abdul Jabbar against Muhammad Sharif and four others. Sharif had earlier filed a complaint against Jabbar under sections 107/151 of the Criminal Procedure Code, and in support of that complaint, three other respondents submitted affidavits. Jabbar then filed his own complaint claiming these affidavits were fake and fabricated, alleging offences under sections 193, 194 and 199 of the Pakistan Penal Code, which deal with giving false evidence and fabricating false evidence.

The trial magistrate ordered a police inquiry, during which the respondents confirmed the contents of their affidavits. Based on this, the magistrate dismissed Jabbar's complaint, and a sessions judge upheld that dismissal on revision. Jabbar then approached the Balochistan High Court.

The High Court dismissed his petition. It held that beyond the affidavits being confirmed as genuine during the inquiry, there was a more fundamental legal problem: under section 195 of the Criminal Procedure Code, offences like the ones alleged can only be prosecuted if the complaint is filed by the concerned court or public authority, not by a private individual. This rule exists to prevent private citizens from misusing the legal process for personal revenge and to let courts decide when such prosecutions are truly necessary. Since Jabbar was a private complainant, his case was not legally permissible from the outset, regardless of its merits.
