Muhammad Alam V. Noor Muhammad and 2 others,

PCrLJ 2012 1756 · Balochistan High Court

This case involved a dispute over whether a Justice of the Peace could order police to directly register a criminal case (FIR) against someone, even after officials had already investigated and found the allegations to be false.

A man named Noor Muhammad had filed a complaint against Muhammad Alam. A Tehsildar (local official) investigated and reported that the allegations were baseless. Despite this, the Sessions Judge, acting as Ex-Officio Justice of the Peace, ordered the Tehsildar to register an FIR against Alam anyway. Alam challenged this order before the Balochistan High Court, arguing it was improperly issued without following the law and that it unfairly prejudiced him despite the earlier finding that the complaint was false.

The High Court agreed with Alam. It explained that under the law, a Justice of the Peace only has the power to ensure police properly entertain a complaint and investigate it if it discloses a cognizable offence—not to directly order an FIR's registration as if guilt were already established. Since the word "may" is used in the law, this power is discretionary, not mandatory, and should not be exercised automatically or bindly.

Because the Tehsildar had already found the complaint false, the court ruled there was no justification for directing an FIR. It set aside the earlier order and instead directed the Tehsildar to properly examine the complaint and register a case only if a genuine cognizable offence was found. This judgment reinforces protections against misuse of the FIR process and clarifies the limited role of a Justice of the Peace in criminal complaints.
