Naimatullah v. State,
PCrLJ 2012 1729 · Balochistan High Court
This case is about a man convicted of drug trafficking under Pakistan's Control of Narcotic Substances Act, 1997. He was the driver of a vehicle intercepted at a checkpoint near Quetta, where police allegedly found 150 kilograms of charas (hashish) hidden in secret compartments. The trial court convicted him and sentenced him to life imprisonment plus a fine, while acquitting a co-accused passenger who claimed he was merely hitching a ride.
On appeal, the driver argued that since the passenger was acquitted on the same evidence, he should be too. He also pointed to inconsistencies, such as the quantity of drugs remaining unchanged even after samples were removed for testing, and a five-day delay in sending samples for chemical analysis.
The Balochistan High Court rejected these arguments. It held that the co-accused's acquittal was justified because there was no evidence linking him to the crime, unlike the driver who was in direct control of the vehicle and therefore in "conscious possession" of the drugs. The court found the delay in sample testing irrelevant since there was no evidence of tampering, and noted that at checkpoint arrests, independent witnesses are rarely available because the public is reluctant to get involved.
The court upheld the conviction and sentence, emphasizing that in narcotics cases, minor procedural discrepancies should not undermine an otherwise solid prosecution case. The appeal was dismissed.
