Abdul Khaliq V. The State,

PCrLJ 2012 1717 · Balochistan High Court

This case is from the Balochistan High Court, deciding a criminal appeal filed by Abdul Khaliq against his conviction for narcotics smuggling.

Abdul Khaliq was arrested along with a driver named Muhammad Yousaf after Anti-Narcotics Force (ANF) officials intercepted a caravan of vehicles believed to be smuggling drugs from Afghanistan to Iran through Pakistan. When the vehicle they were in was stopped after an exchange of gunfire, officials searched it and found 1,280 kilograms of opium hidden in bags on the rear seat. A trial court convicted Khaliq under the Control of Narcotic Substances Act, 1997, sentencing him to life imprisonment and a fine.

On appeal, Khaliq argued he was merely a passenger who had hitched a ride and was not allowed to leave the vehicle once inside, and that the driver, not him, had control over the vehicle and the drugs. He claimed he had no knowledge of the narcotics.

The High Court rejected this defense. It found that the sheer scale of the recovery, sitting in plain view on the rear seat, made it implausible that Khaliq was unaware of the drugs. The court held that once the prosecution proved recovery from the vehicle he occupied, the burden shifted to him to prove innocence, which he failed to do. The court also noted he could not show any reason why ANF officials would falsely implicate him. The appeal was dismissed, and his conviction upheld.
