Shey Mureed  V. The State,

PCrLJ 2012 1691 · Balochistan High Court

This case involved an appeal before the Balochistan High Court by two men, including Shey Mureed, who had been convicted by a trial court for murder and abetment of murder under the Pakistan Penal Code, and sentenced to life imprisonment along with fines.

The background was that two brothers, Assa and Imdad, were shot dead by Nisar and Muheem during a family dispute. Shey Mureed, father of Muheem, was accused of abetting the murders because the deceased allegedly owed him money, and because he was said to have earlier threatened the victims' family along with the other accused, warning them not to leave the area.

The High Court found the case riddled with doubts. The main witnesses against Shey Mureed were the mother and sister of the deceased, whose testimony was uncorroborated by any independent evidence and was inconsistent with each other. The medical evidence did not support their version either. Crucially, no weapon, recovery, or direct evidence linked the appellants to the killing or showed they instigated, conspired, or otherwise aided the actual killers. Since the legal requirements for "abetment" were not met, the court held that the prosecution had failed to prove guilt beyond reasonable doubt.
