Arshad Masih  V. The State,

PCrLJ 2012 1674 · Balochistan High Court

This case involved Arshad Masih, who was convicted by a Sessions Court in Khuzdar for the murder of Samoil Anwar, a fellow member of a church congregation. During a quarrel that broke out among congregants, some of whom were reportedly drunk, Arshad struck the deceased with a flowerpot. The victim later died from the head injury. The trial court had convicted Arshad under section 302(b) of the Pakistan Penal Code, treating it as qatl-e-amd (intentional murder), sentencing him to life imprisonment plus a fine.

On appeal, the Balochistan High Court examined the evidence and found that the trial court itself had noted there was no evidence of premeditated intent to kill. The altercation happened suddenly, in front of a large crowd, and the accused used whatever object was at hand in the heat of the moment rather than a deliberate weapon. Since neither the prosecution nor the complainant had challenged this finding about lack of intent, the High Court held that the correct legal classification was qatl-e-shibh-i-amd (quasi-intentional killing) under section 315, punishable under section 316, rather than full intentional murder.

The court therefore set aside the life sentence and instead convicted Arshad under section 316, sentencing him to 10 years' rigorous imprisonment plus payment of diyat (compensation) to the victim's heirs. This case illustrates how Pakistani courts distinguish between different degrees of culpability in killings based on proven intent, even when a death results from violence.
